Please read the following carefully before attending or purchasing tickets to East Coast Inflate-a-Palooza.
Important Notice: By purchasing a ticket to, registering for, or attending East Coast Inflate-a-Palooza (the "Event"), you confirm that you have read, understood, and agree to be legally bound by all of the Terms and Conditions set out below. If you do not agree, you must not attend the Event. These Terms constitute a legally binding agreement under the laws of Nova Scotia, Canada.
Recommendation: These Terms and Conditions are drafted in good faith to reflect applicable Nova Scotia law. The Organizers recommend that this document be reviewed by a qualified Nova Scotia lawyer, particularly regarding coverage, insurance, and any updates to applicable legislation prior to each Event year.
In these Terms and Conditions, the following definitions apply:

| "Organizers" | Giant Promotions Limited and HRM Mascots & Inflatables (Party Heroes Entertainment Limited), jointly and severally, including all of their respective officers, directors, employees, agents, volunteers, contractors, successors, and assigns. |
| "Released Parties" | The Organizers, together with any co-sponsors, partners, venue operators, equipment suppliers, food vendors, and any other businesses or individuals associated with the production or operation of the Event. |
| "Participant" | Any person who attends the Event, including ticket holders, guests, spectators, and all minors under their care. |
| "Activities" | All inflatable attractions, obstacle courses, rock climbing walls, mechanical rides, slides, bouncy castles, carnival games, train rides, entertainment, and any other activities offered at the Event. |
| "You" / "your" | The Participant and, where applicable, the parent or legal guardian of a minor Participant. |
Participation in the Activities is entirely voluntary. You acknowledge and agree that the Activities involve physical exertion and carry inherent risks of personal injury, property damage, or death that cannot be fully eliminated, even when reasonable safety measures are in place.

By attending the Event, you voluntarily assume full and personal responsibility for all such risks, and you acknowledge that you participate at your own risk.
Read Carefully — This Section Waives Important Legal Rights. By attending the Event, you are agreeing to give up your right to sue the Released Parties, including for their negligence.
To the fullest extent permitted by applicable law, you, for yourself and on behalf of your heirs, executors, administrators, successors, and assigns, hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, demands, losses, liabilities, damages, costs, or causes of action of any nature whatsoever — including those arising from the negligence of the Released Parties — which arise out of or in any way relate to:
You specifically acknowledge that this waiver and release is intended to include claims arising from the negligence of the Released Parties, to the extent permitted by law. This release does not apply to claims arising from the gross negligence, recklessness, or willful misconduct of the Released Parties, as such claims may not be excluded by contract under applicable Nova Scotia law.
This waiver is intended to comply with the Occupiers' Liability Act, RSNS 1989, c 322, and represents a modification of the standard of care owed to Participants in accordance with that Act, to the extent such modification is legally permissible.
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all third-party claims, demands, proceedings, damages, liabilities, costs, and expenses (including reasonable legal fees on a solicitor-and-own-client basis) arising out of or relating to:
Legal Notice: Under Canadian law, parents and guardians generally cannot waive a minor child's independent right to bring a tort claim. The provisions below reflect this limitation and are intended to operate as informed consent and acknowledgment of risk, not as a contractual bar to a minor's future claims.
If you are the parent or legal guardian of a minor (under 19 years of age in Nova Scotia) attending the Event, you agree to the following:
Nothing in this section shall be construed as a waiver of any minor's independent legal rights. The minor's personal release of claims, to the extent enforceable, is limited to the extent permitted by applicable law.
By participating in the Activities, you confirm that:

The Organizers reserve the right, in their sole and absolute discretion, to refuse entry or remove any Participant from the Event, without refund, for unsafe, disruptive, threatening, or inappropriate behaviour, or for failure to comply with safety requirements. This includes intoxicated individuals who pose a safety risk.
The Event is conducted outdoors and is weather-dependent. The Organizers, in their sole discretion, may suspend, modify, postpone, or cancel all or any part of the Event due to unsafe weather conditions, force majeure events, governmental directives, or other circumstances beyond their reasonable control.
In such circumstances, the Released Parties shall not be liable for any damages, costs, or losses — including travel costs, accommodation, or indirect losses — incurred by Participants as a result. Any refund or rescheduling policy will be communicated exclusively through the Event's official social media channels and website. Ticket purchase terms are subject to Eventbrite's applicable policies.
The Event is organized in cooperation with the operators of the Garrison Grounds, Halifax, NS. The Organizers, in their capacity as occupiers or co-occupiers of the Event premises for the duration of the Event, owe a duty of care to Participants pursuant to the Occupiers' Liability Act, RSNS 1989, c 322.
By attending the Event, you acknowledge and agree that the standard of care owed to you under the Act is modified by these Terms and Conditions to the extent expressly authorized by section 4 of that Act, and you accept the reduced standard of care in respect of ordinary negligence claims as described in Section 3 above. Nothing herein shall be read to reduce the Organizers' obligation to avoid reckless disregard for the safety of Participants as required by applicable law.
By attending the Event, you grant the Organizers and their authorized representatives a royalty-free, non-exclusive, worldwide, perpetual licence to photograph, film, record, and use your image, likeness, and voice, and that of any minor in your care, in any media format for the purposes of marketing, promotion, advertising, news coverage, and documentation of the Event, without further notice or compensation to you. If you do not wish to be photographed, you must notify Event staff upon entry.
To the maximum extent permitted by the laws of Nova Scotia, the total aggregate liability of the Released Parties to any individual Participant for any and all claims arising under or related to these Terms or the Event shall not exceed the face value of the ticket(s) purchased by that Participant. In no event shall any Released Party be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, regardless of the legal theory on which such claim is based.
Your ticket to the Event serves as evidence that you have been given notice of, and have agreed to, these Terms and Conditions prior to participation. These Terms are displayed at the Event entrance and are published at ecpalooza.ca/terms. Participation in any Activity after being given the opportunity to review these Terms constitutes your acceptance of them.
The Organizers strongly recommend that physical copies of a signed waiver be obtained at the point of entry for each Participant, particularly for Activities with elevated physical risk, as an additional layer of evidentiary support.
If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable in whole or in part, that provision shall be deemed severed from this Agreement, and the remaining provisions shall continue in full force and effect without modification. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent of the parties.
These Terms and Conditions shall be governed by and construed exclusively in accordance with the laws of the Province of Nova Scotia and the applicable federal laws of Canada. Each party irrevocably submits to the exclusive jurisdiction of the courts of the Province of Nova Scotia for the resolution of any and all disputes arising out of or in connection with these Terms or the Event, and waives any objection to the laying of venue in such courts.
These Terms and Conditions, together with any additional rules or safety notices posted at the Event, constitute the entire agreement between you and the Organizers with respect to your attendance at the Event, and supersede all prior communications, representations, or understandings, whether written or oral, relating to the same subject matter.
By purchasing a ticket to or attending East Coast Inflate-a-Palooza, you confirm that: (a) you are 19 years of age or older, or the parent/legal guardian of a minor attendee; (b) you have read and fully understood these Terms and Conditions; (c) you are not under duress or undue influence; and (d) you freely and voluntarily agree to be bound by them.
